CONTEST IS OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA, 18 YEARS OR OLDER, AND SHALL BE CONSTRUCTED AND EVALUATED ACCORDING TO U.S. LAW. DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA.

  1. CONTEST PERIOD: The Contest begins at 12:01 a.m. Pacific Time ('PT') on December 3rd, 2008 and ends at 11:59 p.m. PT on February 15, 2009. The Contest Period consists of a video submission phase which begins at 12:01 a.m. PT on December 3, 2008 and ends at 11:59 p.m. PT on February 15, 2009 (the "Video Submission Phase"); a voting period which begins at 12:01 a.m. PT on December 3, 2008 and ends at 11:59 p.m. PT on February 15, 2009 (the "Voting Period").

    Log into your account or register with YouTube. You must be a member of the YouTube Web site and comply with its terms and conditions to enter the contest. Membership is free. Follow the onscreen instructions to enter and upload your video submission ("Entry").

  2. CONTEST SUBMISSION:

    1. Video Submission Phase: During the Promotion visit www.youtube.com/scourcommercial and sign in or create a YouTube Account. You must be a member of the You Tube Web site and comply with its terms and conditions to enter the contest. Membership is free. Follow the onscreen instructions to enter and upload your video submission ("Submission").

      Scour will post a commercial that is representative of the company on its main site. Video entry should convey the following:

      1. When you think of Scour.com, how do you feel?
      2. We want you to tell the world what Scour means to you.
      3. It can be anything from a jingle to a skit, but your video entry must feature/include Scour branding, logos, or icons for at least 10 seconds within the video.

      Enter as often as you wish; however, each entry must meet the requirements below and must be submitted separately. Entrants are required to agree to these Official Rules at the time of entry by using the accept feature at the Web site. Entries must be received by contest ends at 11:59 p.m. PT on February 15, 2009. All Web site entrants must have a valid e-mail address. In case of dispute as to identity of the winner who enters, entry will be declared/made by the registered user (meeting eligibility criteria) of the YouTube account, and if a prize is won, it will be awarded to that registered user. Entries generated by a script, macro or other automated means will be disqualified.

      Submission Requirements: Entry must meet all of the following requirements or it will be disqualified. You must abide by these requirements and with YouTube's terms and conditions. Scour, Inc. reserves the right to prescreen, monitor and remove postings, all at its discretion.

      1. Submission must feature/include Scour branding (logos and icons) ("Branding") for a minimum of 10 seconds during the video. The 10 seconds do not have to be consecutive. The Scour brand does not need to be the star of the video.
      2. Submission must be in one of the following formats: .mov, .avi., .wmv or .mpg and must not exceed a file size larger than 100MB or one minute (45 seconds) in length.
      3. Submission must be in English.
      4. Submission must not violate third-party rights including, but not limited to: copyrights, including music copyrights, trademark, and right of publicity. Do not show any third-party trademarks, company names or logos.
      5. Submission must be original, unpublished, the sole property of submitter, and not previously submitted in any other contest.
      6. Submissions must not include unsuitable content or depict or incorporate: unsafe behavior or situations; obscenity; disparagement of any product or person; or other offensive conduct or material, or otherwise include inappropriate content.
      7. Scour assumes that all participants in the video have given their release to use their name, performance or likeness. If your video is selected to go into the finals, all written releases of all participants will be submitted before selection of the final video. You must have written permission from any identifiable person, who appears in, is heard in, or otherwise contributed to the video Submission ("Participant"). Or anyone who has allowed the use of his/her name, likeness/voice or contribution in the video Submission, and Participants must pass along all rights for usage to Scour.
      8. By submitting a video you agree that Scour has the unrestricted right to: use your video Submission in whole or in part, commercially or non-commercially, in any media known or unknown, in perpetuity, worldwide, including the right to publish and display the video Submission for advertising and publicity, and to edit and make derivative works, all without additional review or compensation. Additionally you agree that Scour may post your Submission (including your name) on its Web site(s) and/or its Web pages on third-party sites.
      9. To submit your video, you must read and agree to these official rules ("Official rules") by clicking the submit button. You agree that by submitting this video, you relinquish all rights, as outlined herein, and the video, its characters and content becomes the property of Scour, Inc.
  3. Voting Period: Sponsor will post Submissions that comply with these Official Rules to www.youtube.com/scourcommercial. During the Voting Period, visitors to the website will be invited to vote for their favorite Submission, Taking into account the following judging criteria to determine the finalists: (50%) creativity and (50%) entertainment value (Finalist Judging Criteria").

    Finalists. The three Submissions that receive the most votes by 11:59 p.m.PT, on February 15, 2009 will be determined finalists pending verification. Scour judges will select one (1) grand prize winner from the three finalists which will be judged on 50% originality, 25% humor and 25% creativity. The winner will be notified on or about February 19, 2009 based on the original voting criteria.

  4. PRIZES: One (1) Grand Prize Winner will receive a $500 cash prize and an opportunity to be in, whether with Submission entirety or portion of, the next Scour Commercial.

  5. WINNER:

    • The winner will be required to sign a Winner's Agreement and Release and return it within one week of winning or prize will be forfeited in its entirety and another winner may be selected. By submitting an entry, a winner agrees to allow use of his or Entry, name and/or likeness for advertising this or similar promotions without compensation, unless prohibited by law. All entries and all rights of ownership and publication of same will become the property of Sponsor and will not be returned.
    • By submitting a video you agree that the judgement of the winning video is exclusively determined by Scour. Additionally, you agree that the determination of the winning video will be final and non-contestable.
  6. ELIGIBILITY: Contest open to legal residents of the 50 United States and the District of Columbia, 18 years or older, except employees and the families of Scour, Inc., YouTube, Inc., their respective affiliates, subsidiaries and agencies. Scour, Inc., YouTube, Inc., their affiliated companies, representatives, agents or employees are not responsible for, and shall be indemnified by, the prize winner and entrants against any claims, injuries, losses or damages of any kind resulting from acceptance, use, misuse, possession, or loss of the prize and from any and all use of the video entries. Void where prohibited or restricted by law. Subject to all federal, state and local laws.

  7. OTHER CONDITIONS: Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right in its sole discretion to cancel or suspend this Contest, in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor's control corrupt the administration, security, fairness, integrity or proper play of the Contest. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest by any technical or human errors which may occur in the processing of the entries in the Contest. Sponsor reserves the right to withdraw the transmission of this Contest at any time and award the Prize from among eligible entries received prior to the date of the withdrawal. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or Web site or to be acting in violation of the Rules. Sponsor is not responsible for entries, releases or other required filings, whether electronic or paper and however returned to Sponsor or its agents, that are illegible, late, tampered with, forged, incomplete, misdirected, lost, misplaced, stolen, destroyed or otherwise not in compliance with these official rules, and all such entries will be disqualified.

  8. PRIVACY: Contest entry requires registration at www.youtube.com which will be collecting personally identifiable information, such as name, e-mail address, and phone number. By entering the Contest, you agree to the YouTube, Inc. Privacy Policy, located at: http://www.youtube.com/t/privacy. Entrant registration information will be shared with Scour for the purpose of administering this promotion and potential posting of entries on Scour Web site(s) and Web pages at third-party sites.
